The Economic Crime and Corporate Transparency Act 2023 introduces a new corporate offence: failure to prevent fraud.

Under this legislation, organisations must demonstrate that they have implemented reasonable procedures to prevent fraud committed for their benefit.

While the Act does not prescribe specific preventative methods, it does raise expectations around:

  • Risk assessment
  • Identity assurance
  • Documentation and auditability
  • Consistency of process

Similarly, Right to Work enforcement has intensified, with civil penalties reaching up to £60,000 per breach for repeat offences.

Employers must demonstrate that identity and eligibility checks are robust, and defensible.

  • Ensure processes are structured and audit-ready – Screening should be consistent, documented and aligned with regulatory expectations, particularly in environments subject to audit or inspection.

    The role of Digital ID Verification

    Digital Identity Verification (DIV) has become a central control in managing identity risk.

    When implemented correctly, it provides:

    • A consistent and auditable identity baseline
    • Reduced reliance on manual document handling
    • Fewer downstream errors in DBS, BPSS and BS7858 processes, amongst others
